1. Introduction

Welcome to Game Oracle. These Terms of Service ("Terms") govern your access to and use of the website located at www.game-oracle.com (the "Site"), owned and operated by VespiTech Ltd ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Site.

2. Eligibility

By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of an organization, you represent and warrant that you have the authority to bind the organization to these Terms.

3. Account Registration

To access certain features of the Site, including access to video game industry data, insights, and video game development tools, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Maintain the security of your account by keeping your username and password confidential.
  • Accept all risks of unauthorized access to your account and the information you provide.
  • You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
  • Notify us immediately if you discover or suspect any security breaches or unauthorized use related to the Site or your account.

4. Subscription Service

Game Oracle offers three account options. A Free Account, Individual Account and a Business Account. The Individual and Business Accounts are sold through Link, with Stripe as our Merchant of Record.

A Free Account provides limited access to tools and directories on the platform. An Individual Account provides access to our full suite of data and analysis tools, game industry insights, and video game development tools. A Business Account provides access to everything in and Individual Account plus API and MCP Server access.

When you start an Individual Account or a Business Account, you agree to the following:

  • Subscription fees are due in advance and unless cancelled, will be automatically renewed on a recurring and periodic basis (monthly or annually), depending on the subscription plan you select.
  • All subscription fees are non-refundable, except as required by law.
  • We reserve the right to modify the subscription fees upon reasonable notice to you.

Business Account holders also agree to the Business Account Terms.

All three account types are available worldwide. The Individual and Business subscriptions are sold through Link and Stripe is Game Oracle’s Merchant of Record. Stripe restricts sales to the following countries:

  • Ascension Island
  • China
  • Cuba
  • Iran
  • Kosovo
  • North Korea
  • Russia
  • Syria
  • Tristan da Cunha

5. Pay-As-You-Go Concept Compass Report Terms

  • Pay-as-you-go Concept Compass reports are available to Free Account holders on the Game Oracle platform.
  • Concept Compass Reports are sold through Link, with Stripe as our Merchant of Record.
  • If you have signed up for an account with e-mail and password, you must validate the e-mail address associated with your account before you can purchase Concept Compass Reports.
  • Concept Compass reports are non-refundable once analysis of the concept has commenced.
  • Each Concept Compass Report can be edited and regenerate three times only.
    • It is not possible to purchase more edits for your Concept Report.
    • Edits and subsequent regenerations are only to be used to edit the existing concept, not to validate new, separate concepts.

Subscription Credit Terms

  • Every qualifying Concept Compass Report purchase yields a platform credit equal to the total net amount paid for that specific report.
  • Accrued credits apply exclusively toward eligible recurring platform subscription fees.
  • Credits issue automatically upon verified payment confirmation for the respective report.
  • Each earned credit balance remains valid for exactly 90 calendar days from the transaction date.
  • Expired credit balances forfeit automatically and cannot be reissued or extended.
  • Credits carry zero cash value, cannot be withdrawn, and remain strictly non-transferable between accounts.
  • When multiple reports are purchased, credits accumulate and offset upcoming subscription renewal invoices until fully redeemed.
  • Once credits have been fully redeemed, your subscription will renew at the full price unless you cancel your subscription before renewal.
  • Activating a platform subscription using credits requires maintaining a valid payment method on file.
  • VespiTech Ltd reserves the right to void credits derived from fraudulent transactions or chargebacks.

6. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that might harm, disrupt, or interfere with the functioning of the Site or the enjoyment of the Site by other users. Specifically, you agree not to:

  • Use the Site in any manner that could disable, overburden, damage, or impair the Site.
  • Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose.
  • Introduce any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site.

In addition to the above, you acknowledge and agree that:

  • The interpretation and use of any data, information, or insights provided through our platform are solely your responsibility.
  • You will use the information provided through our services in compliance with all applicable laws and regulations.

7. Intellectual Property

All content and tools on the Site, including text, graphics, logos, images, and software, is the property of VespiTech Ltd or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or create derivative works of any part of the Site without our express written consent.

8. Termination

We reserve the right to terminate or suspend your account and access to the Site, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Site will immediately cease. If you wish to terminate your account, you should do so via your account settings.

9. Disclaimer of Warranties

The Site and all services provided by VespiTech Ltd, including our analytics and insights, are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the operation, availability, or performance of the Site or our services. Specifically:

  • We do not guarantee the accuracy, completeness, or reliability of any data, information, or insights provided through our platform.
  • We do not warrant that the Site or our services will be uninterrupted, error-free, or free from harmful components..
  • We expressly disclaim any responsibility for decisions made or actions taken based on the information or insights provided through our platform.

10. Limitation of Liability

To the fullest extent permitted by law, VespiTech Ltd shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the Site or our services, including but not limited to loss of profits, data, or business opportunities.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on the Site. You are advised to review these Terms periodically for any changes. Your continued use of the Site after any modifications to the Terms will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Terms.
